OFFICIAL RULES FOR CONTESTS OFFERED BY Komo Comfort Foods Inc. ("Komo Comfort Foods" OR "WE" OR "OUR") ON INSTAGRAM (THE "RULES")

CONTEST SPONSOR

Komo Comfort Foods, 1238 Homer Street, Vancouver, BC, Canada.This contest is in no way sponsored, endorsed or administered by, or associated with, Instagram.

HOW TO ENTER: NO PURCHASE NECESSARY:

From time to time, Komo Comfort Foods may sponsor contests on Instagram (each a “contest”). The starting date and time for any such contest and the details to enter will be announced in an Instagram post via Komo Comfort Foods’s Instagram account (instagram.com/KomoComfortFoods).

To enter contest: The method of entry will be provided in the Instagram contest post. For example, you may be asked to “like” the post, tag a friend on the post, leave a comment on the post, answer a question on the post, or share a photo on Instagram and include a specific hashtag(s).

In the event that a contest offered by Komo Comfort Foods requires followers to send a photograph and/or image of any sort, each entrant’s photo entry must:

  • be their original creation, and be a photograph taken solely by entrant. Reproducing, modifying, enhancing or altering a third party's pre-existing work does not qualify as original creation;
  • not violate the rights of any third party, including, but not limited to copyright. For example, photo entry must not defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person's, entity's or organization's personal or proprietary rights, including but not limited to, intellectual property rights;
  • not have been previously used commercially, submitted to another competition or contest, or won any other award;
  • be in “good taste” and in keeping Komo Comfort Foods’s brand image and must not be explicit or offensive, as determined by Komo Comfort Foods, in its sole and absolute discretion;
  • not contain any commercial content that promotes any product or service;
  • not be false, inaccurate or misleading;
  • not violate any law or regulation;
  • not be libelous, threatening or harassing;
  • not instigate others to commit illegal activities or violate human rights; and
  • not contain any viruses, worms, or other interfering computer programming.

An entrant(s)' right to submit a photo entry must not be restricted in any way. Each entrant must be able to provide legal releases for use of their photo entry by Komo Comfort Foods in any format, and materials related to the Contest, including in relation to any third party’s name, likenesses or work ("Third Party Elements") included in your photo entry.

Each selected entrant acknowledges that their photo entries may appear in other electronic and print materials related to the Contest, including promotional materials. By posting a photo, entrant irrevocably, perpetually, and without limitation, grants Komo Comfort Foods the right to use, publish, adapt, sub-license, edit, dispose of, and/or modify such photo entry and the concepts and Third Party Elements embodied therein in any way, in commerce, and in any and all media worldwide in electronic and print materials related to the Contest, and waive all rights, including moral rights, in the photo entry, without notice or compensation, and agree that they may be required to sign a release to that effect.

CONTEST LIMITS:

Only one entry per person, and you may only use one Instagram account to participate. Each complete and eligible response automatically qualifies as an entry to the contest. Komo Comfort Foods does not accept entries for its Instagram contests by phone, fax, courier, mail or email.

ELIGIBILITY:

To participate, you must be an Instagram user who has reached the age of majority in your province of residence and who is a legal resident of Canada excluding Quebec.

Employees of Komo Comfort Foods or any of its affiliates and members of their immediate families, and those with whom they reside, are not eligible to participate. “Immediate family” means mother, father, sister, brother, son, daughter, married or common law spouses, regardless of where they reside. Groups, clubs, organizations, businesses and commercial and non-commercial entities are not eligible. Anyone in Komo Comfort Foods’s sole discretion that is found to (a) be using multiple Instagram accounts to participate or (b) is participating in an attempt to hijack a contest (for example participating in collaboration with other users) will be ineligible, and his/her entries will be judged void.

DISPUTE:

In the event of a dispute, the name and mailing address first sent by Private Message from the holder of the Instagram account will be deemed to be the entrant. The sole determinant of time for the purposes of a valid entry in the contest will be the date stamp on the Instagram post.

WINNER SELECTION (SUBJECT TO CONFIRMATION):

Winner selection is based upon a random draw held at Komo Comfort Foods’s head office located at 1238 Homer Street, Vancouver, BC? following the contest closing date from all eligible entries received. Odds of winning depend on the number of eligible entries received.

PRIZES:

For Komo Comfort Foods sponsored contests on Instagram, the number of prizes to be awarded will range from 1 to 25 with each prize having an approximate retail value ranging between $5 and $500 (Canadian dollars). Prize selection for each contest is at the sole discretion of Komo Comfort Foods but will consist of prizes like Komo Comfort Foods products or gift cards.

Prizes will be set out prior to the start of each contest in the applicable Komo Comfort Foods Instagram contest post. Prizes will be shipped via standard post at no cost to the confirmed winner(s) at the mailing address provided by winner(s). Prize(s) must be accepted as awarded, is not transferable and cannot be exchanged for cash. No telephone contact or correspondence will be entered into except with the selected entrant(s) and confirmed winner(s). Komo Comfort Foods reserves the right to substitute a prize that is, in their sole discretion, a prize of equivalent or greater value.

WINNER CONFIRMATION:

Any selected entrant(s) will be announced via the applicable Komo Comfort Foods Instagram post by direct message to the selected entrant(s)’ username(s). Selected entrant(s) will be required to contact Komo Comfort Foods via Private Message on Instagram to confirm eligibility and provide contact information (full name, email address, and mailing address). Each winner has until midnight PST on the same day the selected entrant(s) is announced to private message Komo Comfort Foods on Instagram and to satisfy all contest requirements, which may include correctly answering, unassisted, a mathematical skill-testing question, among other requirements. If a private message is not received within the prescribed time, the prize may be forfeited and awarded to an alternate entrant. Selected entrant(s) may be required to execute and return by mail and/or email an Affidavit of Eligibility, General Liability Release and Consent to Publicity form within 7 days of notification or the prize may be forfeited and awarded to an alternate entrant.

ACCEPTANCE OF PRIZE:

By accepting a prize, the winner(s) consent to the use of his or her name, photo entry, profile picture, comments and/or likeness for purposes of advertising or promotion without further compensation.

CONDUCT:

All entrants agree to be bound by these Rules, Instagram’s “Terms of Use” and “Photo Sharing Guidelines” and decisions of Komo Comfort Foods. Komo Comfort Foods in its sole discretion, reserves the right to disqualify any person it finds to be in violation of these Rules, Instagram’s “Terms of Use”, or “Photo Sharing Guidelines”. Komo Comfort Foods is not liable if any entrant’s account is suspended by Instagram for violation of Instagram’s “Terms of Service” or “Community Guidelines”. Such entrants will also be disqualified from any Komo Comfort Foods-sponsored contest.

LIMITATIONS OF LIABILITY:

Komo Comfort Foods is not responsible for late, lost, incomplete, irregular, or misdirected “comments”, email or for any computer, online, telephone or technical malfunctions or human errors that may occur. If for any reason, the contest is not capable of running as planned, or more prizes are awarded than planned, including due to a computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort, Komo Comfort Foods may cancel, terminate, modify or suspend the applicable contest. Entrants further agree to release Komo Comfort Foods and Instagram from any liability resulting from, or related to participation in the contests or the awarding or use of any prize. Komo Comfort Foods reserves the right to terminate or withdraw this contest at any time.

PRIVACY:

Entry information collected by Komo Comfort Foods becomes the property of Komo Comfort Foods and will not be used for any purpose other than administering contests on Instagram. For information about Komo Comfort Foods’s privacy practices, read its Privacy Policy located at . Your use of Instagram is subject to Instagram’s Privacy Policy.

GENERAL:

Decisions of Komo Comfort Foods shall be final and binding in all matters relating to contests and the awarding of a prize. These Contest Rules shall prevail, govern and control over contests offered by Komo Comfort Foods on Instagram. The contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. The contest and these Rules are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

These Contest Rules are effective as of March 1, 2021.
